Article III.

Registration and User Account

1. User registration: Registration is required to use the Services of the Portal. The User is obliged, when registering, to truthfully, completely and accurately provide all required data, in particular first name, surname, e-mail address, date of birth, username, password and nationality – this data item is used exclusively for displaying a flag on the profile of the player or Team. Registration is deemed successful only after confirmation of the e-mail address and acceptance of these Terms.

2. Age restriction and consent of a legal representative: Registration of a person under 18 years of age is possible only with the consent of their legal representative. The Operator is entitled to request the submission of such consent, in paper or electronic form, at any time. If the User fails to submit such consent, the Operator is entitled to suspend or cancel the account. The Operator may also restrict access by minor Users to certain functions of the Portal (e.g. chat, financial transactions or advertisements).

3. Account security: The User is obliged to maintain the confidentiality of their login credentials and must not provide them to third parties. If a loss, misuse or suspicion of unauthorized access occurs, the User is obliged to immediately inform the Operator thereof. In such a case, the Operator may temporarily block the account, reset the password, or take other security measures. The User bears full responsibility for all actions carried out from their account up until the moment the misuse is reported.

4. Multiple and unauthorized accounts: Each User may have only one active account, unless the Operator expressly permits otherwise (e.g. within a team or organizational account). Detection of a duplicate or false registration, use of anonymization tools, or provision of false information is grounds for the immediate cancellation of the account and blocking of the User's IP address.

5. The Operator's right to refuse or cancel registration: The Operator is entitled to refuse an application for registration or to cancel an existing account if:

  1. the User has violated these Terms, legal regulations or the principles of fair play,
  2. the account was used for fraudulent, unethical or unlawful activity,
  3. the User interfered with the functioning of the Portal or its databases,
  4. the User published inappropriate or offensive content,
  5. the User themselves requests it. Depending on the severity of the violation, the account may be suspended, permanently cancelled, or the IP address blocked. The User will be informed of such action by e-mail.

6. Cancellation of the account by the User: The User may request cancellation of the account at any time by sending a request to the e-mail address of the Operator stated on the Portal. After verifying their identity, the Operator shall deactivate the account within 30 days of receiving the request. Cancellation of the account does not affect obligations and claims that arose before its cancellation (e.g. payments, receivables, disciplinary proceedings in tournaments).

7. Retention and deletion of data: After the account is cancelled, the User's personal data will be processed only to the extent and for the period necessary to fulfil legal obligations (e.g. accounting or archiving obligations). The Operator retains records of registration, IP addresses and activity logs for a period of no more than 12 months from the cancellation of the account for the purpose of demonstrating fulfilment of legal obligations and protecting its legal claims under Art. 6(1)(f) of the GDPR.

8. Account recovery: The Operator may allow the recovery of a cancelled account at the User's request, if it is technically and securely possible to guarantee the integrity of the data. Recovery of the account is deemed to be a new registration, and the User is obliged to re-accept the current version of the Terms.

Article IV.

Subject Matter and Scope of the Portal's Services

1. Subject matter of the service: The Portal www.blyzer.net is an online platform through which the Operator provides Users with information society services pursuant to § 3 of Act No. 452/2021 Coll. on Information Society Services, consisting in particular of enabling:

  1. the creation and management of player accounts, teams and profiles,
  2. registration and participation in tournaments, leagues and other e-sports events,
  3. tracking of results, statistics, rankings and historical data,
  4. communication between Users through internal messages, chat or notifications,
  5. use of supplementary features, including Paid Services, premium content and marketing opportunities.

2. Nature of the service: The Portal primarily provides technical and organizational support for e-sports activities. The Operator is not obliged to guarantee a User's participation in a Tournament or the outcome of a competition if the Tournament is organized by a third party. The Operator is not a sports club, a betting agency, or a player agent; its role is exclusively intermediary-technical in nature.

3. Free and paid services

  1. Basic functions of the Portal (registration, account management, overview of public rankings) are provided free of charge.
  2. Some functionalities may be subject to a fee – for example, entry fees for Tournaments, premium memberships, extended statistics, advertising, or partner programs.
  3. The scope of Paid Services and their price are always published directly on the Portal or in the user zone, whereby the User is clearly informed of the price, VAT and payment method prior to payment.

4. Third-party services: The Portal may be linked to third-party services such as Stripe (payment gateway), Google Analytics, Discord, Twitch or other API services. The User acknowledges that by using these integrated services, they are also subject to the terms of the respective third-party provider, and the Operator shall not be liable for their availability, accuracy or security.

5. User-generated content: The Portal allows Users to create, upload and publish content (e.g. profile photographs, logos, comments, results). The Operator shall not be liable for the accuracy, completeness or legality of such content and is entitled to remove it at any time if it violates these Terms, legal regulations, or good morals. The User is responsible for ensuring that they hold all rights necessary to publish the given content.

6. Changes and maintenance of the Portal: The Operator is entitled at any time to expand, change, temporarily restrict, or suspend the operation of the Portal, in particular:

  1. for reasons of technical maintenance,
  2. as part of testing new features (beta versions),
  3. for reasons of security or data protection,
  4. for reasons of compliance with the law or instructions of public authorities.

The Operator is not obliged to give prior notice of short-term outages if announcing them would jeopardize the security or integrity of the system.

7. Guarantee of availability and security: The Operator ensures a reasonable level of availability of the Portal, but does not guarantee uninterrupted access or error-free operation of the software. The User acknowledges that the Services may be temporarily unavailable due to network outages, cyberattacks, force majeure events, or actions of third parties. In such cases, the Operator is not liable for direct or indirect damage, data loss, or lost profit.

8. Development and updates: The Operator may continuously update the Portal, change the user interface and the scope of features. The User accepts that some new or test functionalities may be launched only for selected Users (so-called pilot or beta version) and may not be permanently available. In such a case, the service is provided "as is", without any guarantee.

9. Responsibility for sporting and game results: The Operator is not responsible for the accuracy or correctness of data on results originating from Users, Tournament Organizers, or third parties. In the event of a dispute about a result, the final say rests with the Tournament Organizer or a person appointed by the Operator to decide the dispute.

10. Expansion of services The Operator reserves the right to expand the Portal in the future with additional functionalities, such as:

  1. an internal credit system,
  2. a partner program,
  3. a mobile application,
  4. personalized content,
  5. or a system of points and rewards.

If such services affect the rights of Users, they will be added to these Terms in due time.

Article V.

Contractual Relationship and Formation of the Contract

1. The User enters into a contractual relationship with the Operator at the moment of completing registration on the Portal and clicking the "Register" button, by which they confirm that they have read these Terms and agree to them.

2. The contract for the provision of an information society service is concluded for an indefinite period exclusively electronically, without the need for a physical signature. The record of the User's registration and consent is archived as evidence of the conclusion of the contract.

3. If the User acts outside the scope of their business activity, they are deemed to be a consumer and have the right to withdraw from the contract within 14 days of its conclusion, provided that they have not yet started using the Services of the Portal. Withdrawal may be effected by sending a written or electronic notice to the address or e-mail of the Operator.

4. The User acknowledges that by commencing the use of the Services of the Portal (e.g. by registering for a Tournament or activating Paid Services), they expressly agree to the immediate provision of the digital service and lose the right to withdraw pursuant to § 7(6) of Act No. 108/2024 Coll.

5. The Operator may amend the Terms for technical, security or legislative reasons. The User will be informed of changes at least 14 days in advance; if they do not agree with the change, they may terminate the contract without penalty.

6. The contract terminates upon cancellation of the account, withdrawal, agreement of the parties, or dissolution of the Operator.

Article VI.

Paid Services and Payments

1. Some Services of the Portal are subject to a fee, in particular entry fees for tournaments, premium features or supplementary services. Current prices are always published on the Portal and stated in euros including VAT.

2. Payments for tournament entry fees will be able to be made through the Stripe payment gateway (once this option becomes available) or through another approved payment system. The User is responsible for the accuracy of the data entered during payment.

3. If the tournament organizer chooses another form of payment (e.g. bank transfer, cash, or another payment outside the Portal), such payment takes place outside of the Operator, and Fúú.digital, s. r. o. bears no responsibility for it whatsoever, whether in connection with its receipt, processing or refund.

4. After the payment is made, the Operator is entitled to provide the service immediately; the User hereby expressly agrees to the commencement of the provision of the digital service and acknowledges that once performance has commenced, they lose the right to withdraw from the contract pursuant to § 7(6) of Act No. 108/2024 Coll.

5. The Operator is not obliged to refund payments made, except where the service is not carried out through the Operator's fault or for technical reasons on its part. A refund shall be made in the same manner in which the payment was received.

6. In the event of a payment complaint (e.g. a chargeback), the Operator is entitled to temporarily suspend the User's account until the dispute with the payment service provider is resolved.

7. The User agrees to the issuance and delivery of an electronic tax document (invoice) to the e-mail address stated in the account. The invoice is deemed to have been duly delivered on the day it is sent.

  1. they have the right to publish such content,
  2. the content does not infringe the copyright, personality or other rights of third parties.

The User grants the Operator a non-exclusive license to use this content to the extent necessary for the operation of the Portal.

5. A breach of the obligations under this Article may lead to the immediate cancellation or blocking of the account without entitlement to compensation, as well as to the enforcement of damages if the Operator suffers harm as a result of the User's conduct.

Article VIII.

Rights and Obligations of the Operator

1. The Operator ensures the operation and technical functionality of the Portal to the extent of its capabilities and takes reasonable measures for its security and stability.

  1. the User has violated these Terms or the rules of the Portal,
  2. they use the account in a manner that endangers the security of the system or other Users,
  3. they repeatedly violate the principles of fair play, disseminate inappropriate content, or otherwise act contrary to the purpose of the Portal.

5. The Operator reserves the right to carry out technical interventions (maintenance, updates, testing, repairs) without prior notice, if this is necessary to protect the system, data, or the security of Users.

6. The Operator is entitled to temporarily restrict or terminate access to the Portal for reasons of technical maintenance, a cyberattack, legal intervention, or other extraordinary events, without any entitlement of the User to compensation for damages.

2. Without the prior written consent of the Operator, it is not permitted to copy, modify, distribute, publicly display, or otherwise use the content of the Portal for purposes other than personal ones.

3. A User who publishes their own content on the Portal (e.g. a profile photograph, team logo, comment, result, post) thereby grants the Operator a non-exclusive, royalty-free, and time-unlimited license to use it to the extent necessary for:

  1. the operation and promotion of the Portal,
  2. the archiving and display of statistics,
  3. the presentation of the User's activities and results within the Portal.

4. This license is granted for the territory of the entire world and also includes the Operator's right to grant a sublicense to its technical partners (e.g. hosting providers, marketing agencies, tournament organizers).

5. The User is responsible for ensuring that the published content is their own, or that they hold all rights necessary for its publication, and that by doing so they do not infringe the rights of third parties.

6. If the Operator determines that content infringes copyright or personality rights, it is entitled to immediately remove it and to pursue the relevant legal consequences against the User.

Article X.

2. The use of cookies, analytical tools, and similar technologies is governed by a separate document, the "Cookie Policy", which is published on the Portal and also contains options for managing the User's consents.

3. The aforementioned documents form an integral part of these Terms. The User confirms that they have read them and expresses their consent to their content upon registration or use of the Portal.

4. After the account is cancelled, the contract is deemed terminated. The User's personal data will be deleted or anonymized in accordance with the GDPR, except for data which the Operator is required by law to retain (e.g. accounting documents, security logs) or which are necessary to preserve historical records of the course of tournaments and league matches (e.g. results, scores, statistics).
